Program Request for Waiver

The City Engineer shall have the authority and duty of hearing and deciding requests for waivers from the requirements of this program where strict enforcement would cause undue hardship or cause a safety problem. The City Engineer shall make a decision on the matter and respond to the request by mail.

If a waiver is granted, the applicant must agree to pay an additional fee ($30 per year), as set by resolution of the Council. It is the intent of this waiver to only allow sump pump discharge into the sanitary sewer for periods of weather that may cause damage to your system. The holder of the waiver shall allow a City employee to certify that their discharge water connection has been removed from the sanitary sewer prior to April 1 of each year. Failure to provide such certification will place the seasonal waiver holder in violation and subject to a monthly surcharge. Any waiver granted may be recorded at the office of the Clay County recorder.
